'06 ML 350 front diff gone at 59k

I've been experiencing subtle front driveline noise on my '06 ML350 for the last 10k miles or so. Just a low "grinding" from 25 mph on up. Load or turning don't seem to chane it. Finally took it to the dealer a couple weeks ago. Tech couldn't hear anything. Took the shop foreman for a drive, and he confirmed what I was hearing but did not know what it was and they did not get to work on the vehicle that day. Took the service manager for a ride this morning, and he confirmed the noise and said they would check the wheel bearing and change the transfer case fluid.

Well, got the call this afternoon, and they said they found metal shavings in the front diff fluid and think it is bad. Researching this I found 8-10 other case of mostly '06s going out before 60k miles. Dealer offered to pay 1/2 the parts, still leaving me with about a $3k bill. Contacte MBUSA today and they have assigned a case manager to it - said I would hear back in 24 hours. I'd be okay with a 1/3 split shared by me, the dealer and MB. We'll see.

I need to sell this car in a few months to get a '12, but I want it to be in good shape. This was the very first W164 delivered in Oregon (I had the first W163 as well). Guess I'm brave or stupid! Extended warranty will be more appealing on the next one!

Update - MBUSA is saying that can't help. So much for building customer loyalty.

This sucks. I lost mine at 54K but it was CPO and taken care of. I dumped it for a new Ford F150 June of 2010 and glad I did it. The Ford has been in the shop once and for a leak at the satellite antenna. 

If I had time, I could post a list of trouble with that POS starting with conductor plate/ valve body, steering column, sunroof motors, power seat motor, blah, blah, blah.
